PFC H_____, on Sunday, 14 July it was brought to the attention of your chain of command that you, accompanied by a 3/2 CR solider, were caught by a CSM burning out and doing doughnuts in a car in the parking lot of 3/2 CR. That CSM then gave you a lawful order to "stand by" at the CQ desk on Monday, 15 July so that he could talk to you. You then disobeyed this order by leaving or not showing up.
Failing to follow instructions, no matter who delivers them or how trivial you may consider them to be, is a serious offense and will not be tolerated. Furthermore, your actions demonstrate a complete disregard for authority and a lack of respect for Army rank structure even at the highest levels.
You were recently pulled from the deployment roster and are currently pending an Article 15 for another unrelated event, which could result in your eventual separation from the Army. You should be using this time trying to dissuade your chain of command from chaptering you and redeeming yourself, proving to your chain of command that you can be a well behaved, productive, and useful solider who has something to offer the Army in service to your country.
Actions such as those you demonstrated on Sunday and Monday are indicative of a disrespectful soldier who has no regard for rank or Articles of the UCMJ. When you took it upon yourself to leave or not show up to that CQ desk after being told to stand by, it was a direct violation of Article 92, failure to obey order or regulation.
In addition no one should have to tell you that burning out and doing doughnuts in a parking lot on post is illegal. Not only is it illegal, it is also dangerous and another example of not conforming to the rules and regulations required in the military. Actions such as these reflect poorly on you and on our whole chain of command, the unit, and the Army, in general, while guests in a foreign country.
As a result of these actions the commander has deemed it appropriate to impose certain restrictions on you. These restrictions are as follows:
1. Your on post driving privileges are suspended.
2. You are not to enter any other units' company areas.
You are being counseled in accordance with AR 635-200, paragraph 1-16, for your conduct as set forth in Part II above. Any further misconduct, inappropriate actions, or deficiencies in your performance may result in punitive action under the UCMJ and/or initiation of separation UP AR 635-200. Separation action may result in your service being characterized as Honorable, General, or Under Other Than Honorable Conditions (UOTH). An Honorable Discharge entitles you to receive all discharge benefits. A General Discharge may result in substantial prejudice in civilian life and loss of certain benefits, such as civil service retirement credit and educational assistance. An UOTH Discharge could result in substantial prejudice in civilian life, and may result in the loss of most or all benefits as a veteran under both Federal and State laws. Some of the benefits you would not be eligible for with an UOTH discharge are payment for accrued leave, health benefits, civil service preference, reemployment rights, unemployment compensation and naturalization benefits. An involuntary separation might result in recumbent of unearned enlistment bonuses, a loss of G.I. Bill or VEAP educational benefits, and no separation pay. It is very difficult to upgrade a less than honorable discharge.
